1. Agreement to Terms
By accessing and using Metro Motion Co. services, you accept and agree to be bound by these Terms of Service. These terms apply to all users of our adventure recreation services, including visitors, customers, and participants in our activities. If you disagree with any part of these terms, you may not access our services or participate in our adventure activities.
Metro Motion Co. reserves the right to update these terms at any time without prior notice. Your continued use of our services after any modifications constitutes acceptance of the new terms. We recommend reviewing these terms periodically to stay informed of any changes that may affect your rights and responsibilities.
2. Description of Services
Metro Motion Co. provides active recreation and adventure tourism services across Australia, including but not limited to guided hiking expeditions, rock climbing adventures, diving experiences, wilderness trekking, and other outdoor recreational activities. Our services are designed to provide safe, educational, and memorable experiences in Australia's diverse natural environments.
All activities are conducted by certified professional guides and instructors who maintain the highest safety standards. We provide necessary safety equipment and comprehensive briefings before each activity. However, participation in adventure activities involves inherent risks that cannot be completely eliminated despite our safety measures and professional guidance.
3. Booking and Payment Terms
Bookings must be made in advance and are subject to availability. A deposit is required to secure your booking, with the balance due according to the payment schedule provided at the time of booking. All prices are in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice until booking is confirmed.
Cancellation policies vary by activity and are clearly stated at the time of booking. Generally, cancellations made more than 14 days before the activity date are eligible for a full refund minus processing fees. Cancellations within 14 days may incur additional charges. No refunds are available for no-shows or cancellations on the day of the activity.
4. Participant Requirements and Responsibilities
Participants must meet minimum age, fitness, and health requirements specific to each activity. Medical conditions, physical limitations, or concerns must be disclosed at the time of booking. Participants may be required to complete health questionnaires and provide medical clearance for certain activities. Failure to disclose relevant health information may result in exclusion from activities without refund.
All participants must follow safety instructions provided by guides and instructors. Failure to comply with safety procedures, or behavior that endangers yourself or others, may result in immediate removal from the activity without refund. Participants are responsible for bringing appropriate clothing and personal items as specified in pre-activity communications.
5. Assumption of Risk and Liability
Adventure activities involve inherent risks including but not limited to physical injury, property damage, or death. By participating in our activities, you acknowledge and assume these risks voluntarily. While we maintain comprehensive safety protocols and insurance coverage, we cannot guarantee against all possible risks associated with outdoor adventure activities.
Metro Motion Co., its employees, guides, and partners are not liable for injuries, losses, or damages arising from your participation in activities, except where such liability cannot be excluded by law. Participants are strongly encouraged to obtain appropriate travel and activity insurance to cover potential risks not covered by our policies.
6. Photography and Media Release
During activities, Metro Motion Co. may take photographs and videos for marketing, promotional, and educational purposes. By participating in our activities, you grant us perpetual, royalty-free rights to use your likeness in such materials. If you prefer not to be photographed or filmed, please inform your guide at the beginning of the activity.
We respect your privacy and will not use images in ways that could be considered inappropriate or offensive. Professional photos taken during activities may be made available to participants for purchase or download, subject to separate terms and conditions.
7. Environmental Responsibility
All participants must adhere to Leave No Trace principles and respect local environmental regulations. Damage to natural environments, wildlife harassment, or violation of protected area rules may result in removal from activities and potential legal consequences. We are committed to sustainable tourism practices and expect all participants to share this commitment.
Metro Motion Co. works closely with local conservation organizations and indigenous communities to ensure our activities contribute positively to environmental protection and cultural preservation. Participants will receive education about local ecosystems and conservation efforts as part of their experience.
8. Force Majeure
Metro Motion Co. is not liable for delays, cancellations, or modifications to activities caused by circumstances beyond our reasonable control, including but not limited to severe weather conditions, natural disasters, government restrictions, or other force majeure events. In such cases, we will work with participants to reschedule activities or provide appropriate alternatives.
If rescheduling is not possible, refunds may be provided at our discretion, minus any non-recoverable costs already incurred. Travel insurance is recommended to cover additional expenses that may result from such circumstances.
9. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Metro Motion Co. and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without explicit written permission.
The Metro Motion Co. name, logo, and other trademarks are our exclusive property. Unauthorized use of our intellectual property may result in legal action. Any feedback or suggestions you provide about our services may be used by us without compensation or acknowledgment.
